Actos Settlement Funding

Actos itself is a brand name; its medical name is Pioglitazone. It was approved by the US Food and Drug Administration (FDA) in 1999 to treat Type 2 Diabetes. It was created and launched by two companies, Takeda Pharmaceutical Co. and Eli Lilly & Co. Over the following decade many cases were found of congestive heart failure because of the drug. This was not originally listed as a side effect of taking Actos.

Fortunately for you, companies like Uplift Legal Funding have your back. Call us at (800) 385-3660 for more information.

The History of Actos Lawsuits

By the year 2008, Actos was the 10th most prescribed drug and it made over $4 billion in profits for Takeda. By 2010 more than 2 million people received prescriptions for Actos. It was then that the first lawsuit was filed against Takeda, under the False Claims Act. Other lawsuits followed over the next year or two. Studies were done after that that showed a direct link between the drug and heart attacks as well as bladder cancer.

The first trials began in California in 2013 and the first verdict was awarded that same year. Jack Cooper received an award for $6.5 million. This verdict was overturned, and then after that it was re-instated. After that bellwether trials started in 2014. $9 billion was awarded to be split among over 9,000 victims of the drug. It was the seventh largest award in US History. This award was reduced in October of that year.

There were other lawsuits related to Actos that were filed including for the company destroying files and hiding side effects. Settlements ranged from tens of thousands to over $2 million. If you have an outstanding Actos case, whether part of the class action or not, you could be eligible to receive money up front! That’s where companies like Uplift Legal Funding come in.

Side Effects of Actos

Actos can cause a number of number of devastating side effects. These include:

  • congestive heart failure/heart attacks
  • higher risk of bladder cancer
  • edema
  • increased risk of fractures in the arms and hands (in women)
  • liver failure
  • chronic kidney disease
  • lactic acidosis

How Much is My Actos Claim Worth?

Some people have received settlements of over a million, but that does not mean everybody will. The terms of the settlement are divided amongst the 10,000 or so people who filed a claim. That money isn’t split evenly, though. How much you will receive depends on a few factors:

  • how long you took Actos
  • which side effects you experienced
  • what treatment you received for your symptoms
  • if the case is part of the multi-district litigation (MDL) or not

The greater these factors are, the higher on the spectrum your award could be.

How Long Will Actos Settlements Take to Pay Out?

It seems like since the case settled in 2014 everyone should have received their money by now. But 10,000 is a lot of cases to get through. Law firms tend to settle their cases all at the same time. So while some firms have already paid their clients, others haven’t. That doesn’t mean something is wrong with your case. It is possible that your money is still on its way.

That doesn’t stop bill collectors from wanting their money, though. And if you suffered a heart attack or bladder cancer, you may not have been able to work this whole time. You’re not out of luck, though. There are companies who can help you.

Qualifying For Actos Settlement Loans

There are a few things to consider when applying for a cash advance. First, you need to have an attorney representing you. Second, you need to have proof that you took Actos. Third, you need to have suffered one of the side effects listed above. If you are, you could qualify! If you are part of the 2014 settlement, that could be even better. The qualifying process can be quicker for those who were part of the MDL. You could have money in your hand within 48 hours of calling us, or sooner!
